Leg Avenue is the data controller in relation to any personal information that Leg Avenue processes about you and is responsible for ensuring that such processing complies with applicable data protection laws, including the California Consumer Privacy Act (the "CCPA") and the California Privacy Rights Act (“CPRA”). Please be aware that Leg Avenue personnel and employees are required to comply with Leg Avenue’s data privacy practices as set out in this Policy and other data privacy-related policies.

 

THE INFORMATION WE GATHER

The type of information we gather online falls into the following categories:

 

Aggregate Website Usage Information:

We collect and store information about the pages viewed by all of our Website visitors. We may then use this data in aggregate form to identify overall Website visitor behavior patterns. Our goal in using this information is to improve our Website by making it more responsive to the needs and preferences of our users. Our Web servers automatically collect information about each visitor who requests www.legavenue.com Website pages, including your computer's internet protocol (IP) address. Voluntary Registered Shopper Information:

If you visit our Website and plan to receive future newsletters to learn about our later development and promotion, or to purchase our products, you will need to sign up for our newsletter or to may elect to register an online account. The information you provided during these processes are first and last name, email address (used as the username in login), phone number, and password, which may or may not include the day and month of your birth. All such information is collectively referred to herein as “Personal Information.” Personal Information means information that identifies, relates to, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular person or household and includes the type of information listed in this Section, including one or more factors specific to the physical, physiological, genetic, mental, economic, cultural, or social identity of that natural person, or as further defined in the CCPA and/or CPRA. We may also use third parties such as Shopify to process your payment or process your account registration. You may use this username and password to login to your online account to check your order history, order status, order’s tracking number, etc.

 

We do not share Sensitive Personal Information, as defined by California law, for cross-context behavioral advertising. We do not sell sensitive personal information. Sensitive Personal Information includes, but is not limited to, social security numbers, driver's license numbers, state identification card numbers, passport numbers, financial account information in combination with security codes, precise geolocation data, racial or ethnic origin, religious or philosophical beliefs, union membership, genetic data, biometric data for identification purposes, health data, and data concerning sex life or sexual orientation. We only use Sensitive Personal Information for fulfilling orders requested by purchasers and for purposes that do not infer characteristics about consumers.

 

Your sensitive Personal Information will not be used for any additional purposes that are incompatible with the disclosed purposes listed above, unless we provide you with notice and obtain your explicit consent as required by law. You have the right to limit the use and disclosure of your sensitive Personal Information to those uses necessary to perform our services. You have the right to limit the use of your sensitive Personal Information or have your sensitive Personal Information limited by default, which you can exercise by clicking on “Limit the Use of My Sensitive Personal Information” on our home page.

However, we have shared the following categories of personal information for cross-context behavioral advertising: Identifiers (Category A), Internet or Network Activity (Category F), Geolocation Data (Category G), and Inferences (Category K)]. Online Order Information:

If you choose to purchase products from the Website, we require the following information in order to fulfill your order: your name, email address, customer number (if applicable), mailing address, phone number, and payment information. We request an e-mail address during the order process so that we can send an e-mail confirmation message acknowledging the receipt of your order. This message contains your name, address, www.legavenue.com customer number (if applicable), the list of items you purchased, an order reference number, a confirmation of your shipping method, and the total amount of items requested. Please note that this confirmation e-mail does NOT contain your credit card number. If you tell us that you do not wish to have this information used as a basis for further contact with you or if you wish to not share this information with Leg Avenue, Leg Avenue will respect your wishes and you may still browse the Website, but your ability to purchase products from the Website will be restricted as a result.

 

Click-Stream Data, Cookie Technology, Clear GIFs, and Usage Data:

In order to register on or purchase products from the Website, your browser must be set to accept certain essential cookies that are necessary for the Website to function. However, you may decline optional cookies used for analytics, advertising, or other non-essential purposes. A cookie is a small piece of data housed in a text file or folder on your computer's hard drive that helps us recognize you when you visit our Website. Clear GIFs (a.k.a. web bugs, beacons, or tags) are small graphic images placed on a web page, web-based document, or in an email message. Clear GIFs are invisible to the user because they are typically very small (only 1-by-1 pixel) and the same color as the background of the web page, document, or email message. We do not use clear GIFs to collect Personal Information about you; however, we may use clear GIFs to capture statistical usage information for our Website or the services and products offered through the Website. We may correlate this information to a user to personalize the user experience and for statistical analysis of user experiences on our Website.

 

We may also embed social media widgets, such as Facebook, Pinterest, TikTok, YouTube, and Instagram and others as indicated below via a Shopify application to allow you to see things like the number of likes/shares/recommends and “like/share/recommend” our webpages, as applicable for each potential social media widget, and to share product images. These widgets may collect your IP address, your web browser user information, store and retrieve cookies on your browser, embed additional tracking, and monitor your interaction with the widget, including correlating your applicable social media account with whatever action you take within the applicable widget (such as e.g. “liking/sharing/recommending” our webpage), if you are logged in to such applicable social media. For additional social media sites per options on the Shopify application to share product pages, please see your email’s specific data privacy policy as well as, as applicable, Tumblr’s data privacy policy, WhatsApp’s data privacy policy, and Telegram’s data privacy policy. When you interact with these social media widgets, you are also subject to those platforms' privacy policies and terms of service.

 

We also maintain log files that contain IP addresses. In general, we may use log files to monitor traffic on our Website, to troubleshoot technical problems, and to potentially report aggregate information to our advertisers. In the event of user abuse of our Website, however, we may block certain IP addresses or console IDs, as applicable. If available, IP addresses and console IDs may be used to personally identify you in order to enforce our Terms.

Leg Avenue does keep track of the domains from which people visit us and analyzes the data with other non-identifiable information gathered from Website visits for trends and statistics, which is described further in this Policy.

Some services initiated via the Website may require a user to email, telephone, or otherwise contact Leg Avenue, or Leg Avenue to call, email, or otherwise contact the user. Leg Avenue will not contact you by telephone without your prior consent, except to confirm or respond to a request for information and/or to inform a user of the status of such request initiated by a user, if deemed necessary by Leg Avenue. The user should be aware that it is Leg Avenue's practice to monitor and, in some cases, record such calls for staff training or quality assurance purposes.

 

To Create Anonymous Data:

We may create aggregated, de-identified or other anonymous data records from your Personal Information and other individuals whose Personal Information we collect. We make Personal Information into anonymous data by excluding information (such as your name) that makes the data personally identifiable to you. Social media platforms	including Facebook, Instagram, YouTube, Google, and X, and application developers who specialize in social commerce so you can connect to us, share your interests, express opinions about products and services, purchase our products, generate interest in our products and services among members of your social networks, and see personalized advertising on and off our website and the social platforms you use   If you use third party social media features available on our Site, we or the third party may collect or share your data, including your Personal Information. If you do not want us to be able to access information about you, including Personal Information, from Third Party Sites, you must limit data collection and disclosure in the privacy settings on the Third-Party Sites. We reserve the right to remove Personal Information or other data as necessary to comply with our legal obligations, enforce our policies, or protect our rights and the rights of others, subject to applicable data protection laws.   We do not control the third party’s use of your Personal Information and you must separately review such third party’s applicable privacy policies and terms.
The Public	Such as other users of the Site and the public, if such functionality is available and you disclose Personal Information for public use. For instance, you may be able review a product that you purchased, and we will display your name along with the content you submit. We do not control how other users or third parties use any Personal Information that you make available to them. Please be aware that any information you post publicly can be cached, copied, screen captured, or stored elsewhere by others (e.g., search engines) before you have a chance to edit or remove it.

YOUR RIGHTS & CHOICES:

The California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA), grants certain rights to California residents. California defines a "resident" as (1) every individual who is in the State of California for other than a temporary or transitory purpose and (2) every individual who is domiciled in the State of California who is outside the State of California for a temporary or transitory purpose. Access or Update Your Account Information:

Retention and Deletion of Your Personal Information:

 

We retain your data only for as long as necessary to fulfill the purposes for which it was collected, including to satisfy legal, accounting, or reporting requirements. The length of time we retain your data depends on your relationship with us, how you use the Site, and applicable legal retention requirements. Leg Avenue will retain your Personal Information only for as long as is necessary for the purposes set out in this Privacy Policy. Unless a longer retention period is required or permitted by applicable law, we will generally retain Personal Information for no more than seven (7) years from the date of last interaction, except as specified in the retention schedule provided in this Privacy Policy. We will retain and use your Personal Information to the extent necessary to comply with our legal obligations (for example, if we are required to retain your Information to comply with applicable laws), resolve disputes and enforce our legal agreements and policies.

 

Leg Avenue will also retain Usage Data for internal analysis purposes. Usage Data is data collected automatically either generated by the use of the Site or from the Site infrastructure itself (for example, the duration of a page visit). Usage Data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of our Site or we are legally obligated to retain this data for longer periods.

 

You have the right to request that Leg Avenue delete Personal Information collected by Leg Avenue. Upon receipt of such request, Leg Avenue will delete your Personal Information collected as of the date of such request, except when necessary to: (i) complete the transaction for which the Personal Information was provided or perform a contract with you; (ii) detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity and prosecute those responsible; (iii) debug to identify and repair errors that impair existing intended functionality; (iv) exercise free speech (of business or another consumer) or other rights; (v) comply with the California Electronic Communications Privacy Act; (vi) engage in public or peer reviewed research in the public interest; (vii) enable internal uses reasonably aligned with the expectations of the consumer based on their relationship with the business; and (viii) comply with a legal obligation; (ix) use your Personal Information, internally, in a lawful manner that is compatible with the context in which the consumer provided the information.

 

To submit a request to delete your personal information, you must provide sufficient information to allow us to verify your identity, including at minimum your full name and email address. We will use this information solely for the purpose of verifying your identity and processing your deletion request. We will respond to your verified request within 45 calendar days of receipt, unless we need an additional 45 calendar days to respond, in which case we will notify you of the extension within the first 45-day period and provide an explanation for the delay. If your deletion request is subject to any exception under applicable law, we will inform you of the specific exception and the legal basis for it. We will delete your personal information that is not subject to an exception. Once your request to delete is processed and verified, we will delete your personal information from our records and will direct our service providers, contractors, and third parties to whom we have disclosed your personal information to delete such information from their records, except where retention is necessary or permitted under applicable law. For California residents, we will notify third parties to whom we have sold or shared your personal information to delete such information unless this proves impossible or involves disproportionate effort.

 

 

Please note that if Leg Avenue deletes your Personal Information, you may not be able to use certain Website functions that require your Personal Information, and services that require your Personal Information may be disrupted.
